Union Advisory: Weingarten Rights Must Be Asserted

Baton Rouge, LA-Represented employees at all Amalgamated Transit Union Local 1546 properties (CATS, Transdev-LSU, and First Student) are formally reminded that under federal law—specifically the National Labor Relations Act (29 U.S.C. § 157) and the U.S. Supreme Court’s NLRB v. J. Weingarten, Inc. decision—as well as applicable Louisiana labor protections, you have the absolute right to union representation during any investigatory meeting that could lead to discipline; these rights are not automatic and must be clearly invoked by the employee, as employers will not exercise them for you and may attempt to discourage or suppress their use—failure to assert Weingarten Rights can result in waived protections, increased vulnerability, and unilateral employer action.
